Embed Widget Terms of Service

1. Acceptance of Terms

By embedding Malleable's calendar widget or AI chatbot agent on your website, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the embed widget. These terms apply to all users of the embeddable widget, whether on a free or paid plan.

2. License Grant

Malleable grants you a limited, non-exclusive, non-transferable, revocable license to embed our calendar booking widget and AI chatbot agent on websites that you own or operate. This license is conditioned on your compliance with these terms and does not include any right to sublicense, resell, or redistribute the widget as a standalone product.

3. Permitted Use

You may:

• Embed the widget on websites you own or have authorization to manage
• Customize the widget's appearance using the supported configuration options
• Collect bookings and scheduling information from your website visitors through the widget
• Use the AI chatbot to assist visitors with scheduling on your behalf

4. Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the widget or its underlying code
• Remove or obscure Malleable branding from the widget unless you are on a paid plan that includes white-label features
• Resell, redistribute, or rebrand the embed widget as your own product or service
• Use the widget to collect visitor data for the purpose of sending unsolicited communications or spam
• Embed the widget on sites that contain illegal, harmful, or deceptive content

5. AI Agent Terms

The AI chatbot agent embedded on your site is provided on an "as-is" basis. While we strive for accuracy, the AI may produce inaccurate, incomplete, or unexpected responses. You are responsible for reviewing and configuring the system prompt that guides the AI's behavior on your site. Malleable is not liable for any content generated by the AI agent on your website, including any scheduling errors, incorrect information, or misunderstandings that may arise from AI-generated responses. You should inform your visitors that they are interacting with an AI assistant.

6. Data and Privacy

Visitor data collected through the widget (such as name and email for bookings) is processed in accordance with Malleable's Privacy Policy. We do not sell visitor data to third parties. As the embed user, you are responsible for maintaining your own privacy policy that informs your website visitors about the data collection that occurs through the widget. You must comply with all applicable data protection laws in your jurisdiction.

7. Availability and SLA

The embed widget and associated services are provided "as is" without uptime guarantees, particularly for users on the free tier. For Pro plan users, we make reasonable commercial efforts to maintain service availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect widget availability. We are not liable for any losses arising from service downtime or interruptions.

8. Modifications

We reserve the right to update the embed widget, modify its features, or change these Terms of Service at any time. We will make reasonable efforts to notify embed users of significant changes through email or in-app notifications. Continued use of the widget after changes constitutes acceptance of the updated terms. We recommend checking this page periodically for updates.

9. Termination

We may revoke your access to the embed widget at any time if you violate these terms, use the widget in a manner that is harmful to Malleable or its users, or for any other reason at our sole discretion. Upon termination, you must remove the widget from all websites under your control. Sections regarding limitation of liability, data, and intellectual property survive termination.

10. Limitation of Liability

To the maximum extent permitted by law, Malleable and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the embed widget, including but not limited to loss of revenue, data, or business opportunities. Our total liability for any claims related to the widget shall not exceed the amount you paid to Malleable in the twelve months preceding the claim, or $50, whichever is greater.
